DECREE of the PRESIDENT of the PROVINCE March 11, 2011, no. 62/4-Leg
Regulation concerning "Disciplina del Museo delle scienze" (article 25 of the L.P. October 3, 2007 No. 15 (provincial law on cultural activities) (w.b. May 3, 2011, no. 18)
Art. 1
1. In implementation of article 25 of the provincial law No. 15 October 3, 2007 (provincial law on cultural activities), hereinafter referred to as "provincial law", this Regulation shall cover the sort of MUSE's Science Museum.
2. the Museum is located in Trento and is organized in thematic address territorial sections.
Art. 2
Functions and objectives
1. the Museum is a non-economic government, non-profit organization, established to work with the tools and methods of scientific research with the aim to investigate, inform, communicate and inspire on the themes of nature, science and sustainable future.
In pursuit of its purposes the Museum:
a) can be seen in the Museum's ICOM definition;
b) is committed by its personnel in scientific research on the environment and ecosystems;
c) cooperates in the field of research with universities, research organizations and scientific associations;
d) increases their collections through purchases, gifts and donations;
e) provides inventory and cataloguing of scientific collections;
f) takes care of the management of the cultural heritage of its customers, or to their conservation and public enjoyment through promoting the exhibition equipment, temporary exhibitions, educational activities and other cultural events dedicated to the different types of users;
g) work through cultural mediation devices that encourage informal approach, playful, interactive, with science and its technological applications;
h) supports the participation of volunteers at the Museum's activities and promotes the accessibility of all categories of citizens;
s) develops actions of education and informal learning, including through research into educational-pedagogical sector;
j) promotes awareness of the natural heritage and promotes the efforts for the conservation of nature and the environment;
k) supports the knowledge and awareness on the technical and scientific culture and its role in society;
l) promotes the learning of scientific method and spreads scientific knowledge as studies and guidance as possible profession;
m) contributes to the public's continuing education and upgrading of school personnel;
n) collaborates with local and territorial authorities with competence in relation ricercainterpretazione;
or) has to become a reference centre for the scientific museology;
p) participates in the promotion of the local territory;
q) takes care of the production of publications from scientific and educational publications;
r) opens to the public the specialised library and Mediatheque.
Art. 3
Organs of the Museum
1. officers of the Museum:
a) the President;
b) the Board of Directors;
c) the Scientific Committee;
d) the Board of Auditors;
and) the Director.
Art. 4
The Board of Directors
1. the Board of Directors of the Museum consists of five members, including the Chairperson, appointed by the provincial government, one of which is in agreement with the municipality of Trento.
2. the Board of directors remains in Office for the duration of the term during which the provincial is appointed. Its components can be reconfirmed.
3. those who during the term are appointed to replace other members remain in Office until the end of the same.
4. the Board of directors carries out the function of Government, politicoamministrativo address of the Museum, which is consistent with the directives received from the provincial government, and monitoring the performance of the activity.
5. The Management Board shall:
to) adopt the budget, its variations, the settling of budget and final account;
b) adopt the multiannual programme of activities and approve the annual programme of activities;
c) evaluate the work done by the Director and in charge of the Museum's structures, using the assessment centre established by the province;
(d) adopt regulations concerning) the Organization, the personnel organization and accounting and approve other General acts and acts relating to general policy for the Organization and for the performance of administrative tasks and the organic Endowment;
e) approve the conventions, understandings and agreements with other administrations, except those related to management activities;
f) promote or resist ad litem before the courts, including the appointment of the defenders, and transaction settlements, without prejudice to the representation of the Museum
at the end of the President;
g) making any appointments and designations of the Museum in entities, companies and arbitration;
h) determine rates, fees and prices;
the appointment of the Scientific Committee), determining the remuneration in accordance with the provisions of the provincial legislation in force;
j) to buy works of art, collections and archives;
k) give the consulting assignments or collaboration regarding acts reserved to the Board of Directors, as well as consulting assignments or collaboration whose remuneration is above the threshold is determined annually by the Board.
6. the Management Board shall be convened by its Chairman at least twice a year, with five-day written notice, except in urgent cases.
7. for the validity of the sessions is required the presence of the majority of the components. The Council shall act by a majority of those present. In the event of a tie the vote of the President prevails.
8. the duties of the Secretary are taken by the Director of the Museum.
9. the province determines attendance tokens, allowances and reimbursements owed to the President, the Vice-President and the members of the Management Board and the Board of Auditors, taking into account the limits established by provincial legislation in force.
10. The meetings of the Board of Directors may also be teleconference or videoconference. In this case, the President shall verify the presence of the quorum for valid Constitution of the meeting personally identifying and so certain all participants connected in teleconference or videoconference, and ensure
audiovisual tools that allow them, in real time, to follow the discussion and intervene in the discussion of the arguments. The meeting shall be deemed to be held in the place where the Chairman and Secretary.
Art. 5
The President
1. the Chairperson shall be appointed by the provincial government for the duration of the provincial legislature, in the Act of appointment of the Board of Directors of the Museum.
2. the President has the legal representation of the Museum.
3. the Vice-President shall be appointed by the Board of Directors of the Museum and replaces the President in case of absence or impediment.
4. the President shall adopt urgent measures and cannot be postponed ratification of which it submits to the Board of Directors in the next session.
Art. 6
The Scientific Committee
1. the Scientific Committee, an advisory body of the Museum, will remain in charge for the planned duration for the Board of Directors and shall consist of a minimum of three to a maximum of five, appointed by the Board of Directors of the Museum, on a proposal from the Director, between experts of proven training, expertise and experience in the scientific field.
2. the Director finds the person acting as the Secretary of the Committee. The Scientific Committee shall appoint its Chairman.
3. the Director participates ex officio in meetings of the Scientific Committee as a member added. in the event of a tie the vote of the President prevails.
4. the Committee has responsibility for technical and scientific advice, and in particular the same lies:
a) help define the General guidelines of the scientific activities of the Museum;
b) deliver opinions and evaluations about the annual and multiannual programme of activities as well as to individual scientific initiatives or cultural exchange operations;
c) deliver opinions and proposals on purchases in return for payment of goods of interest to the Museum.
5. the Scientific Committee shall be convened by the Chairman at least twice a year, with five-day written notice, except in urgent cases.
6. for the validity of the sessions is required the presence of the majority of the components. The Committee shall act by a majority of those present. In the event of a tie the vote of the President prevails.
7. The Scientific Committee meetings can take place even for teleconference or videoconference in accordance with the procedure laid down in article 4.
Art. 7
The Board of Auditors
1. The control over financial management of the Museum was carried out by a Board of Auditors consists of three members appointed by the provincial government; the President is chosen from among the persons in possession of the necessary requirements for registration in the register of Auditors. The auditors remain in Office for five years. they can participate without
right to vote at meetings of the Board of Directors.
2. In fulfilment of the obligations provided by law, the auditors perform all necessary withholding checks in relation to performance and in particular the obligation to examine the budget, its variations and reporting, and to report to the Board of Directors. Its reports are attached to the accounting documents approved.
3. In case of serious faults found in the administrative and financial management of the Museum during the year, the Board of Auditors is obliged to report to the provincial government.
Art. 8
The Director
1. the Director shall be appointed on the basis of a professional curriculum and training consistent with the skills and experience required for the direction of the Museum, by decision of the Board of Directors, with fixed-term contract, renewable at maturity, with duration not exceeding five years; the emoluments shall be determined by the Board of Directors with reference to that planned for the leadership of the Province according to the directives of the provincial government and taking account of the characteristics of the Museum and of programmes to be carried out. In case of non-renewal, the Board of Directors gives extensive information, nationally and internationally, the expiry of the mandate of the Director;
2. the Director coordinates and directs the activities of the Museum, by ensuring compliance with all standards for sorting and museum functions, program and operates in a coordinated fashion tools and resources allocated for the achievement of the objectives defined by the Board of Directors in the annual programme of activities.
3. the Director shall also carry out the functions laid down in article 17 of the law on the staff of the province and also:
to the formula proposed to) Board of Directors for daperseguire targets, to their financial needs, instrumental and organizational and prepares the programming documents, the budget and the final accounts and its variations;
b) processes and submits the opinion provided by art. 6, par. 4, lit. b) the annual and multiannual programme of activities, refraining from vote Scientific Committee.
c) adopts acts and administrative measures reserved to the Board and performs the required tasks to achieve the Museum's operating results;
d) coordinates the activities of the organizational structures of the Museum;
e) has the responsibility of any title heritage entrusted to the Museum;
f) has the responsibility of staff and is responsible for:
f 1) signature of the individual employment contract;
f 2) the assignment of personnel to organizational structures;
f 3) the adoption of interim measures and the imposition of disciplinary sanctions to staff;
f 4) the resolution of the employment relationship of staff with qualifications inferior to the Director;
g) periodically inform the Board of Directors on the activities carried out and the results achieved.
4. In order for the Museum's activity, the Director responsible for the exercise of its duties to the Board of directors pursuant to executive law responsibility of provincial staff.
5. the assessment of the activities carried out by the Director shall be made by the Board of Directors, through the core of the province's assessment as provided for in article 19 of the law on staff.
6. In the first application of this regulation, without prejudice to what is strictly connected to the results of the evaluation carried out by the core, if the Director of the Museum hired for an indefinite period at the expiration of the mandate is not
reappointed in the same task can be assigned within the limit of the personnel organization, another executive position or can be placed in the Office mobility.
7. where a position as Director of the Museum is awarded to personnel of the province or of the public, the same instrument is in place unpaid leave pursuant to article 62, paragraph 3 bis, of the provincial law on staff.
Art. 9
Relations between the Museum and the Giunta provinciale
1. In harmony with the provincial development program, with guidelines for the cultural policies of the province mentioned in article 3 of the provincial law and other acts of sector programming, the provincial government defines the directives to be conducted at the Museum, for the identification of the objectives to be taken as a priority, for
the elaboration of the work programmes, and for coordination with the activities carried out by other bodies with similar aims, as well as for the financial management of the Museum under specific provisions of provincial laws.
2. Are subject to approval of the provincial government, who shall within 30 days of their receipt, the budget, the budgetary adjustment, the final account, the multiannual programme of activities, the regulations relating to the Organization, the personnel organization and accounting; within such term the provincial government can cancel the acts subject to approval, in case of serious violations of the purposes of the Museum or promote, in case of non-compliance with directives, the review with reasoned. After the predicted term acts are approved.
3. the Museum sends annually to the provincial government, with the account survey, a report on the activities carried out and information from time to time.
4. In case of impossibility of operation found the bodies of the Museum or serious irregularities, the provincial government may order the dissolution of the Board of Directors and appoint in his stead a Commissioner, who is responsible for the day-to-day administration of the Museum and to promote within six months of his appointment, the reconstitution of the Board of Directors.
Art. 10
Programming tools
1. the Management Board shall adopt a multiannual work programme duration corresponding to its mandate, upgradeable annually, which includes objectives, task, standard interventions, procedures for the verification and assessment of the results, as well as its financial needs and how to cover the expenses. The
multiannual programme of activities adopted by the Board of Directors no later than 30 November of the year prior to its validity and its upgrades has been approved by the provincial government. The effectiveness of the multiannual programme is extended until the entry into force of the next program.
2. the multiannual programme identifies the methods, indicators and parameters, such as support tools for evaluating effectiveness, efficiency and economy of the results achieved with respect to programs and costs incurred. To this end, shall apply, mutatis mutandis, the rules laid down by the Decree of the President of the province July 4, 2008, no. 24-131/Leg (Regulation concerning "internal control system on the administrative activities of the autonomous province of Trento").
3. the Board of Directors also approved by 30 November of the previous year an annual activity programme, which constitutes the institution's management program, through which defines the objectives of action by the Administrative Director and the priorities for the achievement of results, content and interventions and the actions to be carried out, indicating the human resources, finance and equipment to give the same to the achievement of the objectives.
4. The annual programme of activities can be upgraded during the year with the same conditions laid down for its adoption.
5. The Treasury of the Museum service is entrusted to the Bank Treasury service owner in the province under the same conditions.
Art. 11
Assets, resources and budgets
1. The provincial government is authorised to put at the disposal of the Museum for free, on the basis of specific conventions, offices, furniture, equipment and goods of its assets.
2. Constitute the Museum's heritage the movable and immovable property which for whatever reason have moved to his property.
3. In case of deletion of the Heritage Museum passes in the Province property that ensures its preservation of collections and a relevant destination in respect of the purposes that inspired the creation of the Museum. The assets provided respectively by the province, municipalities and other bodies or by private individuals, are returning in full owners.
4. the goods are listed in the inventory in accordance with the statutory rules on contracts and provincial heritage.
5. the Museum's revenues shall consist of:
a) by assigning willing by the province for the achievement of policy objectives and institutional tasks;
b) from contributions by other public or private institutions and bodies;
c) from the income and asset management;
d) from money transfers or debt securities to donations, bequests or legacies;
e) from sponsorships and liberal contributions;
(f)) from other income related to the purposes of the institution.
6. the annual budget estimate with the multi-annual budget must be approved together with the programme of activities by 30 November of the previous year to which it refers.
7. The final account, accompanied by an explanatory report financial data and assets, as well as the report on the activities carried out, must be approved by 30 April.
8. the museum shall apply, mutatis mutandis, the provincial legislation in accounting, budget and contracts.
9. the museum promotes the introduction of a control system as a management tool to guide and support leadership in fulfillment of the choices necessary for the achievement of objectives and according to the logic of economic rationality.
To this end the Museum collaborates to the gradual extension of the model of management control of the province and shall undertake to adopt solutions consistent with the provincial model.
10. without prejudice to compliance with the principles established by the provincial legislation on budgetary matters and accounting the Museum may adopt an appropriate accounting rules in order to adapt the financial discipline to the operational needs of the institution. The rules of procedure shall be subject to the approval of the provincial government.
Art. 12
Organization and human resources
1. the Organization of the structure of the Museum ensures adequately and continuously the functions provided for in this regulation.
2. for the operation and for the carrying out of the activity, the Museum uses both its own staff and staff made available by the province or controlled by other entities.
3. the discipline of staff, mutatis mutandis, is established by provincial legislation and collective agreements in the sector, provincial.
4. the staff of the Museum is centered in the Museum's unique role as the professional order foreseen by the provincial collective agreement.
5. the Museum may also take advantage of relationships with external entities for activities
or specialist tasks that can be performed without bond of subordination, pursuant to chapter I bis of the law on contracts provincial and provincial heritage.
6. the organizational structure of the Museum consists of a museum's direction and operational structures identified by the internal rules of organization subject to the approval of the provincial government.
7. the Directorate is responsible for recruitment, indefinitely, unapersona with the Director in accordance with article 17 of the law on staff.
8. to offices, and any special assignments are responsible employees with qualification of the Director referred to in article 29 of the law on staff.
9. staff assessment with the Director in charge of the offices, the Museum relies on the evaluation of core.
Art. 13
Relations with the public and the territory
1. the Museum adopts strategies and operational measures necessary to provide
correct and effective information on facilities, collections and activities, designing joint promotional campaigns along with other museums that operate in the same thematic or territorial.
2. within the framework of its competences, the Museum:
a) promoting, in order to obtain additional financial resources for the activities of the Museum, the collaborations with individuals and public and private entities, aimed at the development and provision of study projects, research and promotion of cultural heritage in the area, particularly with regard to relations with the province, with the local governments, in particular with the municipalities and Museum of your joints, with
the universities and institutions of higher education;
b) promotes partnerships with other museums through the exchange of works and expertise;
c) sets up a continuous collaboration with the schools of any level and order in the territory, for the development of joint projects aimed at the dissemination of culture;
d) promotes volunteerism and signing agreements with associations that safeguard activities and dissemination of the cultural heritage, for the purpose of expanding the promotion and enjoyment of the cultural heritage.
3. the society of natural sciences in Trentino is headquartered and conducts its activities at the Museum. Operates in conjunction with the publication of periodical Museum "Alpine Nature" through the signing of agreements and conventions.
4. the Museum's uniform criteria of effectiveness, efficiency and economy, with a focus on the quality of services to the public, ensuring compliance with the quality standards established by the province and by the body within the Service Charter.
Art. 14
Transitional rules
1. pending the adoption of a new personnel organization in accordance with article 9, paragraph 2, and a new internal rules of organization in accordance with article 12, paragraph 6, are without prejudice to existing ones.
2. If the Director of the Museum has been entrusted with the five-year forecast, as required by article 25 of the provincial law on staff, the expiry of the mandate referred to in paragraph 6 of article 8 shall be set at the end of the current five-year term on the date of entry into force of this regulation, in a row over one or more whole periods calculated with effect from the beginning of the first assignment.
Art. 15
Final rule
1. to the extent not expressly placed on discipline applies to provincial personnel, contracts and accounting for the province by the legislation.
2. In the first application of this regulation, the provincial government, with its deliberation may identify simplified procedures for the preparation of programming instruments governed by this regulation.
Art. 16
1. until the appointment of Museum bodies provided for by this Regulation shall continue to remain in charge of the organs of the Museum appointed pursuant to the provincial law No. 15 of 2007, without prejudice to the provisions of the provincial law No. 3 February 12, 1996 (provisions on the extension of administrative organs).
2. from the date of entry into force of this Regulation shall be repealed:
a provincial law November 27, 1964), no. 14 (establishment of the Museo tridentino di scienze naturali);
b) article 33 of the provincial law No. 13 September 8, 1997;
(c)) the first paragraph of article 20 of the provincial law No. 31 September 12, 1983.
